Cancellation & Refund Policy

This Cancellation & Refund Policy explains how cancellations, refunds, credits, and nonrefundable expenses are handled by Simply Floatin LLC ("Simply Floatin," "we," "us," or "our").
This policy applies to Simply Floatin services and transactions unless a separate written agreement or policy states otherwise.
For vehicle imports, this policy should be read together with the Simply Floatin Vehicle Import Service Terms and the applicable Vehicle Import Service Agreement.
If a signed transaction-specific agreement conflicts with this policy, the signed agreement controls for that transaction.
1. General Principle
Simply Floatin wants customers to understand what can and cannot be refunded before money is committed.
Some Simply Floatin services involve significant work, third-party payments, international transactions, shipping arrangements, customs processing, and other expenses that may become nonrefundable quickly.
Whether a refund is available depends on:
- The type of transaction
- How much work Simply Floatin has completed
- Whether third-party funds have been committed
- Whether a vehicle has already been purchased
- Whether shipping or other services have already been booked
- Whether Simply Floatin has already paid nonrefundable expenses
- The terms of the applicable agreement
2. Import Service Fee
Simply Floatin may charge a separate service or coordination fee for vehicle import assistance.
The amount and payment schedule of that fee will be disclosed before the customer enters into a binding import agreement.
The refundability of the Simply Floatin service fee depends on the stage of the transaction and the work already performed.
Unless a written agreement provides otherwise:
- A service fee may be refundable before Simply Floatin begins substantive work.
- Once Simply Floatin has begun sourcing, reviewing vehicles, communicating with exporters or sellers, preparing transaction records, coordinating logistics, or otherwise performing agreed services, some or all of the service fee may become nonrefundable.
- Once a vehicle purchase has been approved and transaction funds have been committed, the service fee will generally be nonrefundable except where required by law or otherwise agreed in writing.
The Vehicle Import Service Agreement may establish more specific milestones for when the service fee becomes earned and nonrefundable.
3. Before a Vehicle Is Purchased
A customer may request cancellation before a vehicle has been purchased.
If no third-party funds have been committed and Simply Floatin has performed little or no work, the customer may be eligible for a full or partial refund of amounts paid.
Simply Floatin may deduct amounts representing:
- Work already completed
- Nonrefundable administrative expenses
- Inspection costs
- Translation costs
- Wire transfer or financial transaction fees
- Exporter or auction-related costs
- Other authorized expenses already incurred
The customer will be informed of any applicable deductions.
4. After a Vehicle Has Been Approved
Once a customer approves a specific vehicle and authorizes Simply Floatin or another party to proceed, the transaction may begin generating nonrefundable commitments.
These may include:
- Vehicle purchase funds
- Auction charges
- Seller fees
- Exporter charges
- Inland transportation
- Inspection charges
- Documentation charges
- Bank or wire fees
- Other transaction expenses
Cancellation after approval does not guarantee that these funds can be recovered.
Simply Floatin will only refund amounts that are actually recoverable, less authorized expenses and applicable fees.
5. After a Vehicle Has Been Purchased
Once a vehicle has been purchased, the vehicle purchase is generally final.
Simply Floatin cannot guarantee that an overseas seller, auction, dealer, exporter, or other third party will accept a cancellation or return.
If the customer changes their mind after the vehicle has been purchased, the customer remains responsible for the vehicle and authorized transaction expenses unless another arrangement is accepted in writing.
Possible alternatives may include:
- Continuing the import
- Attempting resale overseas
- Attempting resale after import
- Transferring the transaction to another eligible buyer where legally and practically possible
Simply Floatin does not guarantee that any alternative will be available or that the customer will recover the full amount paid.
6. Shipping and Export Costs
Once export processing, freight arrangements, or vessel bookings have begun, associated charges may be partially or fully nonrefundable.
These may include:
- Export preparation
- Export documentation
- Inland transportation
- Freight forwarding
- Ocean freight
- Booking fees
- Cancellation fees
- Marine insurance
- Storage
- Port expenses
- Other logistics costs
Refundability is determined by the applicable third-party provider.
Simply Floatin cannot refund a third-party charge that the third party does not return.
7. Customs, Broker, Bond, and Port Expenses
Customs-related expenses may become nonrefundable after work begins.
These may include:
- Customs broker fees
- Customs bond fees
- Government filing charges
- Customs duties
- Examination fees
- Port charges
- Terminal charges
- Storage
- Documentation charges
- Release fees
Where Simply Floatin has advanced these costs, the customer remains responsible for reimbursement unless the amount is refunded to Simply Floatin by the applicable third party.
8. Simply Floatin Advances
If Simply Floatin pays an authorized transaction expense on behalf of the customer, that payment does not become refundable merely because the customer later cancels the transaction.
If the third party later returns all or part of the payment, Simply Floatin will apply the recovered amount appropriately after deducting any lawful or agreed expenses.
9. Customer-Caused Delays or Cancellation
A customer may remain responsible for costs caused by their own delay, failure to respond, failure to provide documents, failure to provide required funds, or decision to cancel after commitments have been made.
These costs may include:
- Storage
- Demurrage
- Rescheduling
- Cancellation charges
- Transportation costs
- Additional broker work
- Additional documentation
- Port expenses
- Other avoidable costs
Simply Floatin will make reasonable efforts to minimize unnecessary charges.
10. Cancellation by Simply Floatin
Simply Floatin may cancel or suspend a transaction where reasonably necessary because of:
- Suspected fraud
- Illegal activity
- Import ineligibility
- Missing required documents
- Failure to provide required payment
- Material misrepresentation
- Safety concerns
- Sanctions or regulatory restrictions
- Abusive or threatening conduct
- Inability to lawfully complete the transaction
If Simply Floatin cancels a transaction, the customer will remain responsible for authorized nonrefundable expenses already incurred.
Amounts not earned, committed, or otherwise properly retained will be refunded where applicable.
11. Refund Timing
Approved refunds will be processed within a reasonable period after the refundable amount is determined.
Timing may depend on:
- Third-party refund processing
- International bank transfers
- Payment processor timelines
- Verification of final expenses
- Settlement of outstanding charges
Simply Floatin cannot control the processing time of banks, payment processors, exporters, carriers, customs brokers, or other independent providers.
12. Method of Refund
Refunds will generally be returned through the original payment method when practical.
If that is not possible, Simply Floatin may issue a refund through another reasonable method after verifying the customer's identity and payment information.
Simply Floatin will not knowingly send a refund to an unrelated third party without appropriate authorization.
13. Payment Processing Fees
Payment processors, banks, wire services, or financial institutions may charge transaction fees.
If a processing or transfer fee is not returned to Simply Floatin when a transaction is refunded, that amount may be deducted from the customer's refund where permitted by law and the applicable agreement.
14. Chargebacks and Payment Disputes
Customers are encouraged to contact Simply Floatin before initiating a chargeback or payment dispute so that the issue can be reviewed.
A chargeback does not automatically cancel contractual obligations or eliminate responsibility for authorized nonrefundable expenses.
Simply Floatin may provide transaction records, customer approvals, invoices, communications, and other relevant documentation to a payment processor or financial institution in response to a chargeback.
Nothing in this section limits a customer's lawful right to dispute unauthorized or improper charges.
15. Duplicate or Incorrect Charges
If Simply Floatin processes a duplicate or clearly incorrect charge, the customer should contact Simply Floatin promptly.
Verified billing errors will be corrected.
16. Estimated Costs Versus Final Costs
A refund is not automatically due simply because an estimated import cost differs from the final actual cost.
Import expenses can change because of:
- Freight rates
- Exchange rates
- Customs classification
- Government assessments
- Port charges
- Broker expenses
- Inspection requirements
- Transportation costs
- Other third-party charges
If a customer provided more money than ultimately required for authorized transaction expenses, any remaining customer funds will be reconciled according to the applicable agreement.
17. Unused Customer Funds
Where Simply Floatin holds customer funds designated for transaction expenses and the final authorized expenses are less than the amount provided, any remaining amount belonging to the customer will be refunded or otherwise applied as authorized.
Simply Floatin will maintain reasonable records of amounts collected and applied to the transaction.
18. Vehicle Condition and Refunds
Used imported vehicles may have age-related wear, mechanical issues, corrosion, cosmetic damage, previous repairs, or other imperfections.
A refund is not automatically available because a used vehicle requires maintenance or repair after arrival.
Any claim involving inaccurate seller representations, concealed damage, shipping damage, or inspection issues will be evaluated based on:
- Available pre-purchase information
- Customer approvals
- Inspection documentation
- Seller representations
- Shipping records
- Applicable third-party terms
- Any written warranties or guarantees
Simply Floatin will not knowingly conceal material information about a vehicle.
19. Shipping Damage
Damage that occurs during shipping, port handling, or independent transportation may be subject to a claim with the carrier, insurer, terminal, or transportation provider.
Such damage does not automatically entitle the customer to a refund from Simply Floatin.
Simply Floatin may assist with reasonable claim coordination where appropriate.
20. State Registration Issues
A customer's inability to title, register, insure, or operate a vehicle in a particular jurisdiction does not automatically create a right to a refund where the vehicle was legally imported and Simply Floatin did not provide a written guarantee of state registration eligibility.
Customers are responsible for reviewing applicable state requirements before approving a vehicle purchase unless otherwise stated in writing.
21. Merchandise
Merchandise returns, replacements, and refunds are governed separately by the Simply Floatin Merchandise Return & Refund Policy.
This policy does not replace merchandise-specific rules.
22. Automotive Service
When Simply Floatin automotive service becomes available, repair cancellations, deposits, parts orders, diagnostic charges, and service refunds may be subject to separate service terms or work authorizations.
23. Transportation
When Simply Floatin transportation services become available, transportation cancellations, deposits, no-show charges, dispatch fees, and carrier expenses may be governed by separate transportation terms.
Where transportation is provided by an independent carrier, the carrier's cancellation terms may also apply.
24. Events
Event registration, ticket, vendor, or sponsorship refunds may be subject to event-specific terms.
If separate event terms apply, those terms control.
25. No Automatic Refund for Third-Party Delays
Delays caused by exporters, ocean carriers, customs, government agencies, ports, terminals, weather, labor disruptions, transportation providers, or other circumstances outside Simply Floatin's reasonable control do not automatically entitle the customer to a refund.
Simply Floatin will continue to perform its agreed coordination responsibilities where reasonably possible.
26. Force Majeure
A cancellation or delay caused by circumstances outside Simply Floatin's reasonable control does not automatically require Simply Floatin to refund amounts already earned or committed to third parties.
Examples include:
- Severe weather
- Natural disasters
- War
- Civil unrest
- Port closures
- Government action
- Labor disruptions
- Carrier cancellations
- Trade restrictions
- International emergencies
- Other force majeure events
Any unused and recoverable customer funds will still be handled according to this policy and the applicable agreement.
27. Exceptions
Simply Floatin may approve an exception to this policy in writing.
An exception granted in one transaction does not create a requirement to grant the same exception in another transaction.
28. Consumer Rights
Nothing in this policy is intended to eliminate or reduce rights that cannot legally be waived under applicable federal or state consumer protection law.
If this policy conflicts with mandatory law, applicable law controls.
29. Relationship to Other Agreements
This policy should be read together with:
- Simply Floatin Website Terms of Service
- Simply Floatin Privacy Policy
- Simply Floatin Vehicle Import Service Terms
- Simply Floatin Merchandise Return & Refund Policy
- The applicable Vehicle Import Service Agreement
- Applicable invoices, quotes, and authorizations
For a specific transaction, the signed Vehicle Import Service Agreement or other transaction-specific agreement controls where it conflicts with this policy.
30. Changes to This Policy
Simply Floatin may update this policy for future transactions as services, procedures, or legal requirements change.
The "Last Updated" date will be revised when changes are made.
Changes do not retroactively alter an existing signed agreement unless both parties agree or applicable law requires otherwise.
